How State HB 19-1230 – Marijuana Hospitality Establishments – Intersects With Our Smoke-Free Policy Work
The 2019 legislative session included a number of changes to Colorado marijuana regulations, including the option for a local jurisdiction to allow new types of marijuana businesses.
One of those business types, Marijuana Hospitality Establishments, will allow adults 21+ to smoke, vape, and/or consume marijuana in a local business. Local municipalities and counties would need to opt-in through an enacted, initiated, or referred ordinance or resolution to allow Marijuana Hospitality Businesses in their jurisdiction. Though this is a marijuana policy issue, a community allowing indoor marijuana consumption rooms poses a threat to clean indoor air. If your community has been discussing whether to opt-in or opt-out of HB 1230, there is a role for you to play as a tobacco control grantee to preserve the integrity of your local smoke-free laws. This Key Messages Document around secondhand marijuana smoke can inform your approach. Please contact your CSPH TA Provider and STEPP POC if you hear rumblings about your community considering opting in or out of allowing local Marijuana Hospitality Establishments.
