Legal TA: Colorado Clean Indoor Air Act 2019 Update

In May, Governor Polis signed House Bill 19-1076 into law, thereby updating the CCIAA. Beginning July 1st, the use of electronic smoking devices will be prohibited in most public indoor settings. All business, including bars and restaurants will now be smoke and vape free. The only remaining businesses exempt from the law are cigar bars, retail tobacco shops and retail vape shops. Additionally, exemptions for hotels, motels, small business, and assisted living facilities were removed from the law. The perimeter around the main entryway to public buildings was extended to 25 feet, although the CCIAA allows communities that have a lesser entryway perimeter codified as of January 1, 2019 to keep it. As of July 1, 2019 smoke-free protections are expanded to include prohibiting vaping in indoor public places, extending the perimeter of entryways to 25 feet, hotel and motels, all businesses, and assisted living facility common areas. STEPP made an infographic highlighting these updates and a Reference Guide for C.R.S. 25-14 (AKA the Colorado Clean Indoor Air Act) with updates made via HB 19-1033 in bold. As always, contact your legal TA provider with any questions.
