Update on House Bill 2020-1001

where it is scheduled to be heard on Monday, March 2nd.
The House Health and Insurance amendments change the bill to now propose to:
- Allow local governments to pass policy to prohibit the SALE, not possession, of nicotine products.
- Keep in statute, the time period in which a retailer’s violation clock restarts at 36 months.
- Keep a provision of current law that allows a retailer to claim an “affirmative defense” for a violation, however, this amendment limits the use of affirmative defense to once (as opposed to twice) in a 24 month time period.
- Limit vending machines to gaming establishments that are restricted to individuals under 21 years old.
- Clarifies that state compliance checks must be coordinated with local governments and requires alignment on the timing of state and local tobacco retailer licensing.
The bill continues to follow the Colorado Clean Indoor Air Act model for tobacco control in that it sets a statewide minimum standard for tobacco product regulation upon which local communities can build added protections to meet their unique needs and interests.
